Terms of Service | Alenius Digital Growth

This website is owned and maintained by Alenius LLC. By using this website and engaging with Alenius, you are entering into this Agreement with Alenius LLC and indicating that you agree to these terms of service. If you do not agree with these terms and conditions, please do not use this website.

1. Performance Audit Qualification

Alenius reserves the right to determine which businesses are the best fit for our Free Performance Audit. Submission of a request through our “Digital Conversion Infrastructure” does not guarantee receipt of an audit.

2. No Guarantee of Specific Results

As an Advanced Growth Partner, Alenius merges SEO authority and high-performance engineering to scale revenue predictably; however, Alenius in no way guarantees a specific financial result or ranking for the Client. Client understands that results are subject to external variables, including changes to Google’s algorithms or advertising platforms over which Alenius has no control.

3. Non-Disparagement

The Parties agree not to disparage, slander, or defame each other or its principals, agents, or employees during or after the Term of this Agreement. This applies without limitation to all forms of social media and online forums.

4. Limitation of Liability

Alenius warrants that services, including Advanced Local SEO and Cinematic Video Production, will be provided in conformance with the formal proposal. EXCEPT AS EXPRESSLY SET FORTH:

  • (a) Alenius shall have no liability for services provided, including negligence.
  • (b) Maximum aggregate liability shall not exceed the monthly fee paid by the Client in the three (3) months preceding a claim.
  • (c) Alenius is not liable for indirect or consequential damages, including loss of business profits or data storage failure.

5. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond their reasonable control, including acts of God, epidemics, or communications/utility failures.

6. Default and Remedies

If the Client fails to pay any fees, Alenius may immediately pause all “Growth Roadmaps” and active digital infrastructure services until the default is cured.

7. Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Virginia, without regard to choice-of-law provisions.

8. Attorney’s Fees

In any dispute arising under this Agreement, the prevailing Party shall be entitled to recover reasonable attorney’s fees and litigation costs.

9. Entire Agreement and Severability

This constitutes the entire agreement between the parties. If any provision is determined to be invalid, the remaining provisions remain in full effect.

Payment Authorization

I certify that I am an authorized signer for the company. I hereby give permission to Alenius LLC to charge my debit/credit card or electronically debit my bank account (ACH transfer) for the agreed-upon amount each month.

  • Billing Cycle: Auto-debits occur on the same day each month based on the initial “kick-off” date.
  • Fee Changes: Alenius is authorized to adjust debits based on changes in the scope of work (e.g., % of managed ad spend).
  • Processing Fees: Note that a 3% processing fee applies to all credit card payments.
